TERMS OF USE OF WEBSITE
1. Introduction
These Terms of Use (this "Agreement") govern your access to and use of the IFPHK website at https://www.ifphk.org (the "Website"). By accessing or browsing the Website, you are deemed to have read, understood and agreed to be bound by this Agreement. If you do not agree, you must not use the Website.
The Institute of Financial Planners of Hong Kong Limited ("IFPHK") shall not be responsible in any way for any costs, losses or damages whatsoever arising from or in relation to your use of the Website, except as expressly set out in this Agreement.
The heading of each clause is added for convenience of reference only and shall not affect the interpretation of any clause.
For your use of the Online Services (including the Members' Login Area and Online Payment Services), please also refer to the Terms and Conditions of Online Services. For information on how IFPHK handles your personal data, please refer to the Privacy Policy. Both documents are available at https://www.ifphk.org. In the event of any inconsistency or discrepancy between the English and Chinese versions of this Policy, the English version shall prevail.
2. Use of Website Content
2.1 Permitted Use
By accessing the Website, you agree to access all content on the Website (the "Content") — including but not limited to its organisation, layout, text, information, photographs, and graphical images — solely for your own personal, non-commercial use. Subject to the restrictions below, you may download, view, store and print the Content solely for such personal, non-commercial use.
Wherever you download, print or store any Content, you must retain all copyright notices (© IFPHK) intact.
2.2 Prohibited Use
You must not:
a. Use the Content for any commercial purpose, or distribute, publish, broadcast, or reproduce it without IFPHK's prior written consent;
b. Copy, adapt, modify, reverse-engineer, or create derivative works from any part of the Website or Content;
c. Frame or embed the Website or any part of its Content in another website without IFPHK's prior written consent;
d. Use the Website or Content in any manner that violates applicable laws or regulations of the Hong Kong Special Administrative Region or any other applicable jurisdiction;
e. Use automated scripts, bots, crawlers, or similar automated tools to access, extract, scrape, or harvest Content from the Website;
f. Use, copy, reproduce, or extract any Content from the Website for the purpose of training, developing, fine-tuning, or improving any artificial intelligence system, large language model, machine learning model, or automated data extraction tool, whether commercial or non-commercial, without the prior written consent of IFPHK; or
g. Post, upload, or transmit any material that is unlawful, harmful, threatening, defamatory, obscene, or that infringes the intellectual property rights of any person.
2.3 Information Accuracy
The Content is provided for general information and reference purposes only. While IFPHK takes reasonable care to ensure the accuracy and timeliness of the Content, it does not warrant that all, or any part of, the Content is accurate, complete, or up to date. IFPHK shall not be liable for any loss or damage suffered as a result of any reliance on Content published on the Website. All Content is subject to change without notice.
IFPHK does not provide legal, investment, financial planning, or career advice through the Website. Nothing on the Website constitutes professional advice of any nature. You should seek independent professional advice before taking any action based on information accessed through the Website.
2.4 AI-Generated Content Disclaimer
Where IFPHK publishes or makes available any content that has been produced or assisted by artificial intelligence tools, such content will be identified as AI-assisted where practicable. 3. Intellectual Property Rights
3.1 Ownership
All intellectual property rights in the Content and materials on the Website — including but not limited to text, design, layout, software, photographs, and graphical images — are owned by or licensed to IFPHK and/or its licensors. All rights are reserved.
The marks CFP®, CERTIFIED FINANCIAL PLANNER®, AFP®, ASSOCIATE FINANCIAL PLANNER®, QRA® and associated logos are registered trade marks or trade marks of the Financial Planning Standards Board Ltd. ("FPSB") or IFPHK. These marks may not be reproduced, displayed, or used in any form without the prior written permission of IFPHK and/or FPSB.
3.2 Trade Mark Restrictions
Without limiting the above, you shall not:
a. Apply the trade marks or signs similar to them to any goods, services, packaging, business papers, or advertising;
b. Offer, supply, import, export, or advertise goods or services using the trade marks or similar signs; or
c. Cause or permit any person to do any of the above.
4. Downloading and Security
IFPHK does not warrant the absence of delays, failures, errors, omissions, or data loss in respect of information transmitted through the Website. IFPHK cannot guarantee that files downloaded from the Website will be free from viruses, malware, ransomware, or other harmful code, and shall not be liable for any loss or damage caused by such harmful code.
You are responsible for implementing sufficient procedures and security measures — including up-to-date antivirus software, firewalls, and data backup mechanisms — to protect your devices and data from harm.
You are advised to keep your web browser and operating system updated to the latest versions to reduce exposure to known security vulnerabilities.

5.1 Linking to the IFPHK Website
You must obtain IFPHK's prior written approval before creating any hyperlink to the Website from any third-party website. IFPHK may grant or withhold such approval at its absolute discretion. Any approved link must:

b. Display IFPHK's name or website address;

b. IFPHK's total liability for any direct loss arising from use of the Website shall not exceed a reasonable sum having regard to the circumstances of the claim; and
c. These limitations apply regardless of the legal basis of the claim (contract, tort, statute, or otherwise) and whether or not IFPHK has been advised of the possibility of such damage.
Nothing in this Agreement excludes or limits IFPHK's liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any other liability that cannot be excluded or limited under Hong Kong law.
11. Indemnification
You agree to indemnify, defend and hold harmless IFPHK, its officers, directors, employees, agents and representatives from and against any and all claims, proceedings, liabilities, losses, costs and expenses (including reasonable legal fees) arising from or related to:
a. Your breach of this Agreement;
b. Your use of the Website;
c. Any unauthorised modification, insertion, deletion, or use of the Website's Content by you; or
d. Any misrepresentation or breach of warranty made by you in connection with this Agreement.
12. Changes to the Website and This Agreement
IFPHK reserves the right, without prior notice, to update, modify, suspend, or permanently discontinue the Website or any part thereof at any time. IFPHK shall not be responsible to you or any third party for any modification, suspension, or discontinuance of the Website.
IFPHK also reserves the right to amend this Agreement at its sole discretion. Amendments will take effect upon publication on the Website. For material changes, IFPHK will endeavour to provide reasonable advance notice by email or by a prominent notice on the Website. Your continued use of the Website following any amendment constitutes your acceptance of the amended Agreement. If you do not agree to any amendment, you must cease using the Website.
13. Severability
If any provision of this Agreement is or becomes invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary, or if it cannot be modified, it shall be severed, and the remaining provisions shall continue in full force and effect.
14. Waiver
No failure or delay by IFPHK in enforcing any right under this Agreement shall constitute a waiver of that right. Rights and remedies of IFPHK under this Agreement are cumulative and not exclusive of any other rights or remedies available at law.
15. Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region of the People's Republic of China. You irrevocably agree to submit to the non-exclusive jurisdiction of the courts of Hong Kong for the resolution of any dispute arising out of or in connection with this Agreement.
